Terms of Use

1. Acceptance and eligibility

By creating an account, signing in, installing or using the extension, or otherwise using the Service, you agree to these Terms and the Privacy Policy. If you use F-Assist for a clinic or organisation, you confirm that you are authorised to accept these Terms for that organisation.

You may use the Service only if you are at least 18 years old, are authorised by a registered clinic or imaging centre, and can lawfully enter and manage the relevant Form F records. If you do not agree, do not use the Service.

2. What F-Assist provides

F-Assist provides workflow tools that may include:

• capturing, validating, saving, and updating Form F information;
• generating Gujarati-script names for staff review;
• issuing clinic register numbers and showing workflow status;
• creating printable or PDF copies of Form F;
• recording scan results and Government Form-F numbers;
• maintaining clinic registers, filters, queues, and status counts; and
• using the browser extension to enter clinic-approved records into the Gujarat Government PC&PNDT portal.

Features may differ by device. Portal filing depends on the desktop browser extension and is not promised on mobile devices.

3. Clinic and user responsibilities

The clinic and each user are responsible for:

• maintaining a valid clinic registration and using qualified, authorised medical professionals;
• providing all notices, obtaining all consents, and establishing another lawful basis where required;
• checking that patient, clinic, doctor, indication, result, declaration, Gujarati-script, and portal data are accurate and complete;
• reviewing the final Form F before printing, signing, filing, or relying on it;
• obtaining signatures or thumb impressions and preserving authenticated paper and electronic records for the period required by law;
• meeting all filing dates, monthly reporting duties, and instructions of the Appropriate Authority;
• confirming that each portal submission succeeded and that the Government Form-F number was captured correctly;
• correcting or reprinting a form when a saved record no longer matches the paper copy;
• protecting login credentials and admin passcodes and removing access for staff who leave or change roles; and
• keeping suitable independent records and continuity procedures in case the Service or portal is unavailable.

Generated translations, validations, statuses, counts, and reminders are workflow aids. They can be incomplete or incorrect and do not shift professional or statutory responsibility from the clinic.

4. Acceptable use

You must not use the Service to:

• conduct, facilitate, request, advertise, or record unlawful sex selection or sex determination;
• create a false, misleading, backdated, unauthorised, or incomplete statutory record;
• access another clinic's information or use credentials you are not authorised to use;
• upload malicious code, interfere with security controls, probe the Service, or disrupt other users;
• circumvent Government portal access controls, rate limits, or legal requirements;
• copy, resell, sublicense, or commercially exploit the Service except under a written agreement with F-Assist; or
• reverse engineer the Service except to the limited extent such restriction is prohibited by applicable law.

You must promptly notify F-Assist if you discover unauthorised access, a data incident, a material filing error caused by the Service, or misuse of the platform.

5. Accounts and access

The clinic is responsible for activity performed through its accounts. Credentials should not be shared outside authorised clinic personnel. Where a clinic uses a shared workstation, users should lock the device or sign out when it is unattended.

F-Assist may require additional authentication, including an admin passcode, for clinic settings and destructive actions. These controls supplement, but do not replace, the clinic's own access-management duties.

6. Clinic data and privacy

The clinic retains responsibility for the records it enters and for deciding how patient data is used. The clinic authorises F-Assist and its service providers to process that data only as needed to provide, secure, support, and lawfully operate the Service.

F-Assist does not claim ownership of clinic or patient records. F-Assist retains ownership of the Service, software, interfaces, documentation, branding, and related intellectual property. Our handling of personal information is described in the Privacy Policy.

Before closing an account or ending use of F-Assist, the clinic must ensure that it has preserved every record it is legally required to keep. Account closure does not erase or reduce statutory duties.

7. Government portal and third-party services

F-Assist is an independent workflow tool. It is not the Gujarat Government, the Appropriate Authority, Supabase, Cloudflare, Google, or the operator of the Government PC&PNDT portal, and it is not endorsed by them unless expressly stated in writing.

The Service relies on third-party systems that can change, reject data, become unavailable, or impose their own terms. Portal automation does not guarantee acceptance, legal compliance, uninterrupted access, or successful filing. Users must review the official portal response and resolve any discrepancy with the portal or Appropriate Authority.

Use of Google sign-in, the Government portal, browser stores, or other third-party services is also governed by those providers' terms and policies.

8. Availability, support, and changes

We aim to keep F-Assist reliable, but the Service may be interrupted for maintenance, security, provider outages, internet failures, legal requirements, or changes to the Government portal. We do not guarantee a particular uptime or that every feature will always remain available.

We may add, change, or retire features to improve security, usability, or compliance. We will give reasonable notice when a material change is expected to substantially affect normal clinic workflows, where practical.

9. Disclaimers and limitation of liability

F-Assist is an administrative software tool. It does not provide medical advice, diagnose a condition, perform a scan, interpret an ultrasound, provide legal advice, or certify compliance with the PC&PNDT Act or any direction of an Appropriate Authority.

To the extent permitted by law, the Service is provided "as is" and "as available", without implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, or error-free output.

To the maximum extent permitted by law, F-Assist will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for lost profits, lost data, missed filing deadlines, portal rejection, professional discipline, regulatory action, or business interruption arising from use of the Service.

Where liability cannot be excluded, F-Assist's total aggregate liability arising from the Service will not exceed the fees paid by the clinic for the Service during the 12 months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded or limits rights that cannot lawfully be waived.

10. Suspension and termination

The clinic may stop using the Service at any time, subject to any separate subscription or order terms. We may suspend or terminate access when reasonably necessary to address unlawful use, a security risk, non-payment, breach of these Terms, a legal requirement, or risk to patients, clinics, the portal, or the Service.

Where practical and lawful, we will provide notice and an opportunity to correct the issue. Terms that by their nature should survive termination, including responsibilities for existing records, intellectual property, disclaimers, liability limits, and governing law, will continue to apply.

11. Changes to these Terms

We may update these Terms when the Service or applicable law changes. The updated date will appear at the top. If a change is material, we will provide reasonable notice through the Service or the clinic's account contact. Continued use after the effective date means the clinic accepts the revised Terms.

12. Governing law

These Terms are governed by the laws of India. Subject to any mandatory dispute-resolution or jurisdiction requirement under applicable law, disputes will be submitted to the competent courts in Gujarat, India.

If any provision is held unenforceable, the remaining provisions will continue. A failure to enforce a provision is not a waiver. These Terms and any written commercial agreement with the clinic form the agreement governing use of the Service; the written commercial agreement controls if it expressly conflicts with these Terms.
